Student Molestation Case: Offender's Bail Plea Rejected, Sent to Judicial Custody for 15 Days
In continuation of the legal proceeding of a suo motu case, the accused of molestation Haobam Ibomcha is produced before Cheif Judicial Magistrate, Imphal West by the I.O Rattana Ngaseppam of the case in connection with FIR No. 279(10)2022 IPS u/s 354 IPC along with a prayer for remanding the accused person into Judicial Custody for 15 days i,e till 24-10-2022.
The counsel for the accused person moved remand objection along with a prayer for releasing the accused person on bail.
However, Ld. APP submitted that the accused had wilfully and intentionally taken advantage of the situation and thereby physically assaulted and molested the young girl on her way to tuition. As it is also the case of the prosecution that the entire incident was caught on CCTV and that the said footage was also submitted to the court for reference. Ld. APP further submits that such crimes against women are increasing in society and as such unless stricter actions are not taken, like in the present case, then there will be no deterrent effect in society. Furthermore, it was also submitted that investigation is still ongoing and as such remanding the accused to judicial Custody is highly necessary.
On the other side Ld. Counsel for the accused strongly objected on the ground that the act of the accused was not intentional, however merely pushed to avoid collusion due to the bad condition of the road and there was no use of force or exhibition by the accused person.
Upon the hearing, CJM/IW responded that "The existence of prima facie material and upon perusal of the CCTV footage and considering the early and critical stage of the investigation, the CJM/IW view that the accused be remanded to judicial custody for 15 days whereas the bail petition stands rejected."
Meanwhile, the young girl has also given her statement to Magistrate Court Lamphel this morning.
The Women Action for Development (WAD) on Thursday condemned the unfortunate and shameful incident in which a 43-year-old man molested a young girl at Keishampat Thiyam Leikai in Imphal West on October 4.
In a release, WAD stated that “the incident occurred due to the failure of the authorities to protect and safeguard the future generations of society.”
WAD is highly concerned about the girls who go out of their homes for their studies, it added. It also highlighted the importance of reforming the structural formation of a society to prevent such crimes against women and girls.
"It extended acknowledgment to the people who have supported the victim throughout her tough times, especially those who played major roles in bringing justice. It also appealed to the state government to establish dedicated facilities to protect young students from such unwanted incidents."
