Kishorchand Wangkhem Sentence Six Months Imprisonment with fine:

Kishorchandra Wangkhem also known as Wangkhemcha Wangthoi, 43, who was earlier detained under the National Security Act in 2018, was charged with sedition. He was later arrested for a communally derogatory remark against the Maram Tribe on his Facebook post on September 2020.

As soon as his anticipatory bail was rejected by Session Judge, Senapati on September 28, police arrested him on the 12th of October morning in connection with FIR registered following a complaint by the Maram Women Union to Senapati police station under section 124A/153A/505 IPC and 3(1)(r)SC and ST POA Act, 1989.

The case was related to his Facebook post, “Wangkhei AC da Tribal Voter Yamna Lei, Nupi atombi (Meitei) na nupi ahal (Maram) da ‘Haothu Haonubi’ hairadi vote khomdokloidra”?

Following the case on 2nd May 2023, the special Judge Senapati ordered sentencing to six months and a fine. The Public persecutor argued that offenses of such types are increasing day by day and further submits that the accused persons have been convicted u/s 3(1)X) of Schedule Caste & Schedule Tribe (Prevention of Atrocities) Act, 1989 and minimum punishment in the case is 6 months. It also submits that probation is barred in the cases of SC/ST acts on these grounds. Ld. Spl. PP submits that Convict deserves maximum punishment. The punishment includes 6 months imprisonment and a fine for the offense under Section 3(1)() of the Schedule Caste & Schedule Tribe (Prevention of Atrocities) Act, 1989. 

According to reports, the post had been made by the wife of a BJP politician of the state in response to a reportedly derogatory comment and ‘racial slur’ about her by a Meitei woman close to her husband. The wife belongs to a tribal community of the state.

The politician’s wife in her Facebook post identified herself as a woman from the Maram community of the state’s Senapati district.
