Ningthoujam Popilal Singh has applied for anticipatory bail under section 438 CrPC at the Court of Sessions Judge in connection with the FIR No. 32(2)2023 LPS, Imphal West, coupled with an ad-interim relief, through his learned counsel.
Ningthoujam Popilal Singh, the petitioner, in his humble petition, pointed out that on 09/02/2023 when the BJYM President and a friend got physically assaulted around 9:10 pm at a turning near a church in Langol near Shija Hospital, he was teaching some of the local children nearby his residence. However, a team of police personnel led by one ASI - L. Premananda Singh of Lamphel P.S came to the residence, frantically searched the petitioner's house and turned everything upside down in an attempt to arrest him.
So, the petitioner prays for the grant of anticipatory/pre-arrest bail, inter- alia, on the following grounds among others,
a)That the petitioner is quite innocent and has committed no offense.
b) That the petitioner has been implicated falsely by the opposite party due to previous enmity.
c) That the petitioner is a respectable person having sufficient means in the locality, and hence there is no chance of absconding or tampering with the evidence.
d) That the petitioner apprehends arrest by the police according to the complaint and might put to unnecessary harassment, mental agony, and inconvenience.
e) That the petitioner shall make himself available for interrogation by a Police Officer as and when required.
f) The petitioner shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case to dissuade him from disclosing such facts to the court or any Police officer.
g) The petitioner shall not leave Manipur State without the previous permission of the Court.
h) The petitioner may be imposed under sub-section (3) of section 437 as if the bail were granted under the section.
With all these into consideration, this Court is of the opinion that it would be proper to consider the prayer of the petitioner for the grant of anticipatory bail or interim relief only on receipt of a report from the OC Lamphel PS.
Hence, the OC Lamphel PS has been directed to submit a detailed report of the FIR case returnable on or before 16 February 2023.
